Terms and Conditions of Use for Quicklist Traders Limited

1. Introduction

1.1 Welcome to quicklist.co.zm (the "Site"). By accessing or using our services, you agree to be bound by these Terms and Conditions (the "Terms").

1.2 The Site is operated by Quicklist Traders Limited, company registration number 120241012590.

1.3 The Terms, our website terms of use, and all policies and additional terms posted on and in our sites, applications, tools, and services (collectively "Services") set out the terms on which Quicklist Traders Limited offers you access to and use of our Services.The Website Terms of Use, all policies, and additional terms posted on and in our Services are incorporated into these Terms. You agree to comply with all the Terms when accessing or using our Services. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

1.4 These Terms govern the ordering, sale and delivery of Goods, and the use of the Site.

1.5 Despite your geographic location, when you use our Site you do so in accordance with these Terms and provided that any delivery address, including for returns collections, is a delivery address within the borders of the Republic of Zambia.

1.6 These Terms are binding and enforceable against every person that accesses or uses this Site (“you”, “your” or “user”), including without limitation each user who registers as contemplated under paragraph 2. By using the Site and by clicking on the “Register Now” button on the Site, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms.

1.7 In these Terms, Quicklist Traders shall be referred to as "Quicklist," "we," or "us" or “our.”

2. User Registration

2.1 To use certain features of the Site, you must register for an account.

2.2 During registration, you agree to provide accurate, current, and complete information about yourself. You must maintain and promptly update your account information in the event of changes to keep it accurate, current, and complete.

2.3 You are responsible for safeguarding your login credentials and any activities or actions under your account. You agree to notify us immediately of any unauthorised use of your account.

2.4 You agree not to share your login credentials with any third parties, unless you require that authorised third parties (employees, agents, etc.) have access to your account.

2.5 You shall not transfer your Quicklist account (including feedback) and user ID to another party without our consent.

2.6 Users must be at least 18 years old or have the permission and supervision of a parent or guardian to use our platform. Users must have capacity to enter legally binding agreements. Persons declared bankrupt or entities placed under liquidation or similar insolvency processes shall not be permitted to use this Site without the permission and supervision of the trustee, administrator and/or liquidator as may be the case.

2.7 Users must not create additional accounts to circumvent selling restrictions, buying limits, suspension, or to manipulate any Site feature.

3. Seller Requirements (Listing and Selling Items)

3.1 The seller is fully responsible for the accuracy and content of the listing, including listing content created by third parties such as translation, image editing, and generative artificial intelligence tools.

3.2 Sellers must provide valid identification and, where applicable, proof of business registration, telephone number, website and email address.

3.3 Where a seller is a legal person, the seller must provide its registration number, names of its office bearers and its registered place of business.

3.4 Sellers must ensure that the physical address provided is valid for receipt of legal service of documents.

3.5 Sellers must ensure that all items listed for sale comply with Zambian laws and regulations.

3.6 Sellers must not sell and will promptly remove all listings for any product recalled by a manufacturer or governmental agency if the sale of the product is prohibited by law or regulation or if the product poses a health or safety hazard as specified by any governmental agency. We have no responsibility or liability for the safety or performance of any product that you list or sell using our Services, including any product that is subject to a recall. The Seller shall be solely responsible for any non-conformity or defect in, or compliance with any public or private recall of, any product you list or sell using our Services.

3.7 Sellers must not list counterfeit or prohibited items. Prohibited items include, but are not limited to:

3.7.1 illegal drugs and substances

3.7.2 stolen goods

3.7.3 counterfeit items

3.7.4 hazardous materials

3.7.5 wildlife products

3.8 We are committed to complying with Part 7 of the Competition and Consumer Protection Act of Zambia and Part 8 of the Electronic Communications and Transactions Act. As such, sellers must ensure that:

3.8.1 all products listed on the Site are accurately described and disclose any defects or issues. Listings should include clear descriptions, pricing, and images of the item being sold. To ensure that the seller is giving consumers an accurate representation of your items, and that you're not infringing on anyone else's content rights, you should write your own descriptions and use your own images.

3.8.2 consumers have the right to clear and sufficient information regarding the goods and services offered, including transportation and other miscellaneous costs, terms of agreement and any guarantees that may be offered to the consumer and how those terms of agreement may be accessed by the consumer.

3.8.3 sellers must adhere to product safety standards and not engage in deceptive, misleading, or unfair practices.

3.8.4 consumers have the right to seek redress for any legitimate complaints about the goods or services provided.

3.9 Sellers must not engage in price manipulation or any other unfair business practices.

3.10 Listings on Quicklist are subject to expiration after a period of 60 days unless renewed by the seller. Sellers are responsible for updating or removing their listings once an item is sold or no longer available. Inactive or outdated listings may be removed by Quicklist without notice. Quicklist reserves the right to remove any listings reported as inactive or irrelevant by users. Additionally, failure to log in or engage with your account for a certain period may result in the automatic expiration of your listings.

3.11 Listings that are blank, or don't offer a tangible item or service, are not allowed because they can cause confusion for buyers and increase the risk of fraud.

3.12 As a seller, you are not required to agree to a buyer’s request for any additions, alterations or any variation from the terms of your listing. Sellers will be protected from negative feedback and defects where a buyer makes a demand which is not part of the original listing and the seller delivers the item purchased by the buyer according to the original terms of your listing.

3.13 The seller must state its return, exchange and refund policy in the listing.

3.14 Sellers must communicate promptly, politely and professionally with Site users.

3.15 By listing an item, you agree to pay us a commission on the final sale price of the item.

3.16 You ensure that the item fits the parcel of the delivery option made available to the buyer and is safely packaged.

3.17 Once an item is sold, Sellers must ship the item promptly in accordance with the agreed-upon shipping method and within the timeframe in which the goods will be dispatched.

3.18 Sellers must ensure that the listed items must be in your inventory or you must have an existing agreement with a third party to fulfil the delivery of the item under the terms of your listing.

3.19 When using integrated courier services, the Seller agrees to comply with the respective policies of these Services regarding shipment requirements and packaging standards, acknowledging that the courier service's policies apply to the shipping process.

3.20 The Seller shall not be liable for any failure to deliver goods or services listed on this Site or for any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, floods, fires, explosion or accidents.

3.21 The User confirms that they are aware that the obligation to declare and pay taxes (including VAT and income tax) on all transactions lies with the User.

4. Buyer Requirements

4.1 Buyers are responsible for reviewing the item description and terms of sale before making a purchase.

4.1.1 Buyers should also be aware that some listings may remain posted after an item has been sold or is otherwise unavailable. While we strive to keep all listings up to date, there may be occasional delays in removing sold or expired listings. Quicklist is not liable for any inconvenience caused by outdated listings, but buyers can report inactive listings to help ensure timely updates.

4.2 A legally binding contract to purchase an item will come into effect between you and the seller when you buy the item, commit to buy the item and your offer for the item is accepted, regardless of when payment is due or received, unless the transaction terms state that you are required to pay for the item before a binding contract is formed.

4.3 A buyer is not entitled to request for any additions, alterations or any variation from the terms of your listing, unless the seller agrees to such accommodations.

4.4 Where a payment issue arises, and a seller cancels an order due to a failed or incomplete payment, this unpaid cancellation will be recorded on the buyer's account. A buyer with excessive unpaid cancellations may have limits imposed by a seller or by us, or they may lose their buying privileges. Buyers can appeal an unpaid cancellation recorded on their account using the dispute resolution process outlined in paragraph 7.

4.5 For the avoidance of doubt, there is no contract between us and the buyer of listed items for transfer of legal ownership from the seller to you.

4.6 Buyers must ensure that any feedback given about the use of the Site or a purchase is fair and constructive.

4.7 We have strict anti-abusive behaviour policies. Abusive behaviour by buyers, includes misuse of feedback, returns, buyer protection programs, or payment dispute processes. Failure to pay for items is a violation of our abusive buyer policy. Breach of our abusive buyer policy may result in account suspension or restriction by us, subject to our appeal process.

4.8 Any disputes between buyers and sellers should be resolved through our dispute resolution process outlined in paragraph 7.

5. Fees and Payments

5.1 Quicklist is committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

5.2 Quicklist.co.zm charges a 15% commission on sales made through the platform. This commission covers bank transfer charges but does not include any additional fees for payment processing.

5.3 Quicklist.co.zm charges a flat fee of ZMW 200.00 for promoting items on our website and social media platforms. Please note that the 15% commission fee will still apply on sales made through the platform.

5.3.1 Featured Landing Page: Premium listings will be displayed prominently in the "Featured Listings" section on Quicklist's website landing page. The listing will remain featured for a period of 14 days.

5.3.2 Featured Story: Premium listings will be showcased on Quicklist's official social media accounts (Instagram and Facebook) through Stories. Each listing will be featured in the story for 24 hours and saved in a dedicated "Featured Listings" highlight for extended visibility.

5.3.3 Main Feed Post: In addition, premium listings will be posted to Quicklist's social media feed. For enhanced exposure, the listing may be pinned to the top of the feed for 3-5 days before it becomes part of the regular feed.

5.4 Payment processing fees are managed by a third-party provider and are not included in the 15% commission charged by Quicklist.co.zm. Sellers are responsible for any additional fees incurred during payment processing.

5.5 Payment for fees must be made according to our payment terms. Failure to pay fees may result in account suspension or termination.

5.6 You warrant that you are fully authorised to use the debit card and mobile money account supplied for the purpose of paying for the goods.

5.7 Commission and selling fees do not confer a Seller with exclusive rights to item exposure on our Services. We may display third-party advertisements (including links and references thereto) or other content in any part of our Services, including listings, in our sole discretion and without consent from, or payment, fee reduction, or other credit to, sellers.

5.8 All transactions must be conducted in Zambian Kwacha (ZMW).

 

6. Returns and Refunds

**6.1 Return Policy**

6.1.1 Buyers may request a return within 48 hours of receiving the item, in compliance with the Zambian Consumer Protection Act and subject to the seller’s refund policy.

6.1.2 Items must be returned in their original condition, with all packaging and tags intact.

**6.2 Refund Policy**

6.2.1 Refunds will be issued to the original payment method within 3 \- 5 business days once the returned item is received and inspected.

6.2.2 The seller may deduct return shipping costs from the refund amount, unless the item is defective or not as described.

**6.3 Return Process**

6.3.1 To initiate a return, buyers must contact the seller through quicklist.co.zm to request a return authorization.

6.3.2 The seller will provide instructions for returning the item.

6.3.3 Buyers must provide proof of return shipment, such as a tracking number.

**6.4 Exceptions**

6.4.1 Certain items, such as custom-made products, and digital downloads, may not be eligible for return.

6.4.2 Items marked as "final sale" or "non-returnable" are not eligible for return.

6.5 If you have not received a refund yet, first check your bank account or contact your bank, as it may take some time before your refund is officially posted. If you still have not received your refund after the prescribed time for such has lapsed, please contact us at [support@quicklist.co.zm](mailto:support@quicklist.co.zm).

7. Dispute Resolution

7.1 Users should attempt to resolve disputes directly and amicably with each other.

7.2 If a resolution cannot be reached between the users, users can escalate the dispute to quicklist.co.zm by contacting us at [support@quicklist.co.zm](mailto:support@quicklist.co.zm).

7.3 We will investigate and mediate the dispute. Our decision in dispute resolution is final and binding.

7.4 In accordance with the Zambian Consumer Protection Act, consumers have the right to seek redress through appropriate consumer protection authorities if they believe their rights have been violated.

8. User Conduct

8.1 The User undertakes to ensure that their activities are lawful and in accordance with good practice. Prohibited actions include:

8.1.1 posting defamatory, offensive, intimidating, or harassing material or material that contains or amounts to hate speech is otherwise unlawful.

8.1.2 promoting sexually explicit material.

8.1.3 violence or unfair discrimination based on race, sex, religion, nationality, disability and age.

8.1.4 publishing personal data or breaching other privacy rights.

‎8.1.5 sharing or promoting unlawful, false, or inaccurate information.

8.1.6 engaging in fraudulent transactions.

8.1.7 providing false information.

8.1.8 acting and using the site in bad faith.

8.2 Users must respect the privacy and rights of other users. Any misuse of personal information is strictly prohibited.

8.3 Users of the Site agree to not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the Site. In addition, you agree that you will not in any way use any process to monitor, copy, distribute or modify the Website or the information contained herein, without the prior written consent from an authorised Quicklist representative.

9. Intellectual Property

9.1 Users retain ownership of the content they post on the Site. By posting content, users grant Quicklist a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, and display the content.  To the fullest extent permitted under applicable law, Users waive the right to enforce their intellectual property rights, in that aforesaid content against Quicklist, our assignees, our sublicensees, and their assignees in connection with our, those assignees', and those sublicensees' use of that content in connection with our provision, expansion, and promotion of our Services.

9.2 Users must not post content that infringes on the intellectual property rights of others.

9.3 Users represent and warrant that for all the content you provide, you own or otherwise control all necessary rights to do so and to meet your obligations under these Terms.

9.4 Users also represent and warrant that their content is accurate, appropriate, and legal. You represent and warrant that use of any such content (including derivative works) by us, our users, or others in contract with us, and in compliance with these Terms, does not and will not infringe any Intellectual Property Rights of any third party.

9.5 Quciklist is not responsible and assumes no liability for any content provided by a User or any third party intellectual property infringement.

9.6 All content included on this site, such as text, graphics, logos, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of Quicklist or its content suppliers and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of Quicklist, with copyright authorship for this collection by Quicklist, and protected by international copyright laws.

10. Limitation of Liability

10.1 Quicklist is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our Site.

10.2 We do not guarantee the accuracy, completeness, or reliability of listings. Users rely on the information displayed and/or provided at their own risk.

10.3 Whilst we take reasonable measures to ensure that the content displayed on the Site is accurate and complete, we make no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability or functionality of the Site or as to the accuracy, completeness or reliability of any listed information on the Site. If any such representations or warranties are made by our representatives, we shall not be bound thereby.

10.4 Services listed on the Site may, under certain specifically defined circumstances, be under warranty, however, the Site itself and all information provided on the Site is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.

10.5 We also make no warranty or representation, whether express or implied, that the information or files available on the Website are free of viruses, spyware, malware, trojans, destructive materials or any other data or code which is able to corrupt, destroy, compromise, disrupt, disable, harm, jeopardise or otherwise impede in any manner the operation, stability, security functionality or content of your computer system, computer network, hardware or software in any way. You accept all risk associated with the existence of such viruses, destructive materials or any other data or code which is able to corrupt, compromise, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation or content of a computer system, computer network, any handset or mobile device, or your hardware or software, save where such risks arise due to our gross negligence or wilful misconduct.

10.6 Any views or statements made or expressed by Users on the Site are not the views of Quicklist, its directors, employees and/or agents.

11. Linking to Third Party Websites

11.1 Any links or references to other websites (“Third Party Websites”) on our Site are outside of our control, including those of advertisers. These Terms do not apply to those Third Party Websites and we are not responsible for the practices and/or privacy policies of those Third Party Websites or the “cookies” that those sites may use.

11.2 Notwithstanding the fact that the Site may refer to or provide links to Third Party Websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained thereon.
